Western Montana Oil and Gas Lawyer
Having mineral rights in Montana can raise a lot of important issues where you require a lawyer. Whether your property has coal, oil, or gas, negotiating and protecting your mineral rights is
very important to your land ownership.
I'm Brad Aklestad, a lawyer who focuses on mineral rights and oil and gas law in western Montana. Whether you need an oil and gas title opinion or you have a dispute involving post-production damage claims, the outcome of your case truly depends on your choice of an attorney. I have successfully handled many oil and gas cases over the years and am skilled at helping clients present their best case to the court.
I represent oil and gas exploration and production companies before regulatory agencies such as the Montana Board of Oil and Gas. I also represent landowners and associations of mine owners and land owners in negotiating and drafting leases for mineral rights on their property.
I represent my clients' interests in the following types of legal issues:
Oil and gas title opinions
Title disputes
Contracts amongst operators for drilling and purchase contracts
Land acquisitions and contracts
Litigating royalty payments
Natural resource damage claims
Oil and gas disputes concerning operating agreements and surface access rights issues.
Creation of joint operating agreements
Pooling and utilization agreements
Payment of post-production costs, which are costs incurred by non operators after production
Pooling agreements are frequently used by oil and gas producers to join small tracts of land together to have sufficient acreage to receive a drilling permit and to share production by interest owners in such a pooled unit. Unitization agreements are used to consolidate mineral or leasehold interests covering all or part of a common source of supply to maximize production.
My Background
When you are looking for a lawyer for your farm operation, it's important to select someone who understands your heritage, lifestyle, and needs. I am also a farmer and lawyer with lifelong roots in Western Montana. My experience as a landowner gives me a practical, hands-on perspective that an attorney who comes from outside of the agricultural and natural resources industries may not have. I am a lawyer who understands the perspective of property owners.
I was raised on a family farm in north-central Montana growing wheat and barley, and today I operate much of the original farmstead. Like many other young farmers, I am committed to preserving the farm and ranch legacy for my family.
